Terms of Service

Acceptance of these terms

By creating an account or using Kompete you agree to these Terms and to the Privacy Policy and Community Guidelines. If you don't agree, don't use the app. You must be at least 18 years old. The service is provided by Nitish Kumar Gupta (sole proprietor, trading as Kompete).

Your account

Keep your sign-in details confidential and give accurate information. You are responsible for activity under your account. Tell us at support@kompeterun.com if you suspect unauthorised access.

Using Kompete

Kompete is a running and fitness app for personal, non-commercial use. Don't reverse-engineer, scrape, overload or interfere with the app or its services, bypass security or App Check, tamper with purchases or try to get Premium features without paying for them, or use it for anything unlawful.

Safety and health disclaimer

Running and outdoor exercise carry inherent risk. You use Kompete at your own risk. Obey traffic laws, stay aware of your surroundings, and exercise within your ability. Consult a doctor before starting a training programme. Kompete's metrics (including VO₂ max, race predictions, recovery/readiness and training load) are estimates based on the data available; they may be inaccurate, are for general fitness information only, and are not medical advice, diagnosis or treatment. GPS and sensor readings can be wrong.

Your content

You keep ownership of what you post (photos, text, activities, messages). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display and distribute that content in and for operating Kompete, to the audience you choose. You confirm you have the rights to what you post and that it follows our Community Guidelines. When you delete content or your account, the licence ends, except for copies others have already received or that we must keep by law.

Fair play and prohibited conduct

Activities and challenge results rely on honest data. Spoofing GPS or sensors, uploading fabricated activities, using bots, harassing others, posting unlawful, hateful, sexual or dangerous content, or sharing other people's private information (including home locations) is prohibited. We may exclude or remove flagged activities from statistics and challenges.

Moderation and enforcement

You can report posts, comments and messages and block users in the app. We may remove content, restrict features, or suspend or terminate accounts that break these Terms or the Guidelines, with or without notice where needed to protect users. To contest a decision email support@kompeterun.com.

Kompete Premium subscriptions

Some features are available only with Kompete Premium, a paid subscription. The plans, prices and any free trial are shown in the app before you subscribe, in your local currency, exactly as the store will charge them.

• Billing: you buy through Google Play or the Apple App Store, and the store charges your account. We never see or store your card details. Any taxes are calculated and shown by the store at checkout.
• Free trial: if a plan offers a free trial, it is for new subscribers who have not used a trial of Kompete Premium before. When the trial ends, the subscription starts and is charged at the price shown, unless you cancel before the trial ends.
• Automatic renewal: a subscription renews automatically for the same period and at the then-current price until you cancel. If the price changes, the store will notify you as its rules require.
• Cancelling: cancel any time in Google Play (Subscriptions) or the App Store (Subscriptions), at least 24 hours before the renewal date. You keep Premium until the end of the period you have paid for. Uninstalling the app or deleting your Kompete account does not cancel a subscription.
• Refunds: payments are handled by the store, so refund requests go to Google Play or Apple under their policies. We cannot refund store payments ourselves.
• Restoring: use "Restore purchases" in the app to recover Premium on a new device or after reinstalling, signed in to the same store account.
• Changes: we may change which features are in Premium, and add or remove plans or promotions. If a feature you are paying for is removed during a paid period, you can cancel and ask the store for a refund of the unused period.
• Estimates: Premium features such as VO2 max, race predictions and training-load charts are estimates from your own data, for general fitness only (see "Safety and health disclaimer").

Challenges and rewards

Challenge rules are shown in the app. We may change, cancel or correct a challenge or its results for fairness or technical reasons. Challenges have no cash value unless stated.

Third-party services

Kompete relies on services such as Google/Firebase, maps providers, Health Connect and your device's app store. They are governed by their own terms, and we are not responsible for their availability.

Our property

Kompete's software, branding and content (other than yours) belong to Nitish Kumar Gupta (sole proprietor, trading as Kompete) or its licensors. You may not copy, modify or distribute them except as these Terms allow.

Termination and deleting your account

You can stop using Kompete and delete your account any time from Settings → Account → Delete Account; this permanently removes your data as described in the Privacy Policy. We may suspend or end access as described above.

Disclaimers and limits of liability

Kompete is provided "as is" and "as available" without warranties of any kind, to the extent allowed by law. To the extent allowed by law, we are not liable for indirect, incidental, special or consequential damages, loss of data, or injury arising from your use of the app, and our total liability for any claim is limited to the greater of the amount you paid us in the previous 12 months or USD 50. Nothing in these Terms limits liability that cannot be limited by law, including consumer rights where you live.

Changes to the service and these terms

We may update the app and these Terms. For material changes we will notify you in the app and may ask you to accept the new version. Continuing to use Kompete after a change means you accept it.

Governing law

These Terms are governed by the laws of India. Subject to any mandatory consumer protections where you live, the courts at Delhi, India have exclusive jurisdiction over disputes.

General

If a provision is unenforceable the rest stays in force. Failure to enforce a right isn't a waiver. These Terms are the whole agreement between you and us about Kompete.
